URGING NEED FOR HIGH SECURITY SET UP IN COURTS





With the incident that took place yesterday evening in the Rohini Court in Delhi is something which cannot be neglected, where in an under trial alleged gangster Jitender Gogi was shot dead by two people dressed as lawyers these two people belonged to his rival gang, who were also shot dead by the police staff present there.

This was not the first instance when such shootout took place in the court premises earlier in Dwrarika Court, Saket Court and Karkardooma Court Delhi such incidents took place in 2019 and back in the year 2017. Its not just about Courts in Delhi. An incident of such violence was reported in a courtroom of Bijnor, U.P., in the year 2017, Agra, Madras, Odisha etc.

The present CJI Hon’ble N. V. Ramana after yesterday’s incident as discussed in raised concern and the Supreme Court decided to take suo moto cognizance on the matter of safety in courts and the safety of judiciary also. the former CJI Hon’ble  SA Bobde in January 2020 asked the government to consider a separate cadre of CISF for the security in Courts premises but then it was refused by the Central Government. But if we see such violent acts in courts the Government should take initiative along with the Judiciary and the Executive, to decide and formulate a mechanism in establishing a proper administrative set up for the safety, if we see all around the country at least 25-30% population is in courts every day and the life security of everyone is the Right given by our Constitution broadly under Articles 14, 15 and 21.

Advocate Deepa Joseph through Advocate Robin Raju has said the images and videos of the incident have “jolted mentally”, since there is a chain of such incidences now there is an utmost need for establishing some straight jacket security formula, and anyone who has entered the court in the guise of an Advocate cannot be waited to be entertained with negligence.

Further, she also raised concern like yesterday’s incident where the police with the hit of the moment fired people who were in lawyers attire, this is frightening for lawyers because some time some innocent lawyer can also be fired and bought to death if such incidents keep on happening the police personal present there will never frisk back.”


The concern is a valid one there should certain measures taken like installing CCTV cameras in the courts not only in the higher courts but also in districts courts, on the entrance there should be trained personals who should check every one while entering the court premises like its done in metro stations, no one should be allowed to enter the premises with the weapons with an exception to the security staff which are present in the court premises.

Yes, these processes are time taking and would require a lot of funds from the treasury of the Government of India, but something to be prioritized is the life safety of the people coming to the courts, no one be it an accused or a victim or a declared convict or may be any other person deserves to die in such a manner because in India we have laws to govern and let those laws decide Rights and punishments for the people.
